Does one appointment meet the UK and EU Responsible Person rules?

No: the UK and EU Responsible Person rules come from different laws. An EU Responsible Person answers for the EU market, and the UK has its own product rules. So one appointment does not cover both.

Article 16(1) of the GPSR requires an operator established in the Union, for products placed on the Union market. The UK sits outside the EU member states. So a UK business cannot be that operator.

The General Product Safety Regulations 2005, in turn, define their market as the market of Great Britain. Northern Ireland follows the EU rules. For cosmetics, GOV.UK guidance says Northern Ireland must have a Responsible Person established in Northern Ireland or the EU.

So under the UK and EU Responsible Person rules, what you need follows where you sell. That can be the EU, Great Britain, or both. A seller outside both markets who sells cosmetics into both needs a responsible person on each side.

A seller outside the EU with other consumer products needs the EU operator for the EU market. It then checks what Great Britain asks for that product.

Do cosmetics sold in Great Britain need a UK responsible person?

Yes: a cosmetic sold in Great Britain needs a responsible person established in the UK. Schedule 34 replaces Article 4 of the Cosmetics Regulation as it applies in Great Britain. Under the new Article 4(1), you may not place a cosmetic on the market without one.

The new Article 4 follows the EU pattern. A UK manufacturer is the responsible person for a cosmetic it makes in the UK. That holds unless the cosmetic leaves the UK and comes back before it goes on the market.

Any importer that places a cosmetic on the market is its responsible person. An importer or a UK manufacturer may designate a person established in the UK by written mandate.

For Great Britain, Eldris acts as the Responsible Person and does not take on UK importer duties. GOV.UK guidance adds that the Responsible Person needs a UK established address. A mail-forwarding or PO box address does not count.

For cosmetics, the UK and EU Responsible Person rules need one appointment on each side. A UK appointment does not meet the EU rule, which asks for a person designated within the EU.

The cosmetics FAQ goes further, and the guide for beauty brands selling in the UK covers that market alone.

Do general consumer products need a UK representative?

No: for general products sold in Great Britain, a UK representative is optional. The General Product Safety Regulations 2005 (SI 2005/1803) say who the producer is if the maker is outside the UK.

Under regulation 2, the producer in that case is the maker's representative established in the UK, if it has one. In any other case, the producer is the UK business that places a product from outside the UK on the market.

The definition names a representative only where the maker has one. The text of the Regulations contains no duty to appoint one.

For general products, the UK and EU Responsible Person rules therefore differ. The EU requires an operator established in the Union. Great Britain makes a representative optional.

Among the producer's measures, where reasonable, is its name and address on the product or its packaging (regulation 7(4)).

Sector rules, such as those for toys, are separate from the 2005 Regulations. This guide does not cover them, so a seller of a regulated product should read the Great Britain rule for that product first.

How do the UK and EU Responsible Person rules compare?

The UK and EU Responsible Person rules ask for different things, and the gap is widest for cosmetics. The table sets the rules cited in this guide side by side.

In the EU, the rule is the same in every member state. One operator established in the Union can act for you across it.

At Eldris, each EU member state and the UK is one market. So one order can cover your UK and EU Responsible Person appointments. The guide to adding markets later covers a market you add after onboarding.

How do you add the UK to an Eldris appointment?

Add the United Kingdom to the same order. It is a separate appointment for Great Britain, at the same market fee as an EU member state. Your one monthly plan covers it.

EldrisAI holds the UK appointment, not EldrisAi OÜ, and it covers Great Britain only. You can choose it alongside your EU markets or on its own. So Eldris covers the UK and EU Responsible Person roles through two companies.

For Great Britain labels, the name and address are EldrisAI, Unit 1, Out of the Woods, Halton, Lancashire, LA2 6ND, United Kingdom. The email address is compliance@eldris.ai.

When an order has EU markets and the UK, the certificate names both companies. It follows within 60 minutes of completing onboarding.

Ordered with your EU markets in one sitting, the UK counts as one market towards the multi-market discount on the market fees. The monthly plan, priced by SKU count, does not change when you add it.

Start in the onboarding form, which shows the quote before you pay. The guide to one EU Responsible Person covers the EU side. The Responsible Person FAQ keeps the short answer.

Frequently asked questions

Does my EU Responsible Person cover Great Britain?

No: an EU appointment covers the EU market, and the UK has its own product rules. For a UK and EU Responsible Person in one order, Eldris adds the United Kingdom as a separate appointment for Great Britain. EldrisAI holds it, at the same market fee and on the same monthly plan.

I only sell in the UK. Can Eldris act for me there?

Yes: you can choose the UK alongside EU markets or on its own, as a separate appointment for Great Britain that EldrisAI holds. It costs the same one-off market fee as an EU member state. You also pay the monthly plan, priced by SKU count, which covers every market you hold.

Which Eldris details go on Great Britain labels?

EldrisAI, Unit 1, Out of the Woods, Halton, Lancashire, LA2 6ND, United Kingdom, with the same compliance email address as the EU details. For EU markets the details are EldrisAi OÜ, Ruunaoja tn 3, 11415 Tallinn, Estonia. So the UK and EU Responsible Person details differ only in name and address.

Does Eldris take on UK importer duties?

No: appointed for Great Britain, Eldris acts as the Responsible Person and does not take on UK importer duties. EldrisAI holds that UK appointment for you, and it covers Great Britain only. Under Schedule 34, any importer that places a cosmetic on the market in Great Britain is its responsible person.

What about Northern Ireland?

Northern Ireland follows the EU rules, not the Great Britain rules set out in this guide. For cosmetics, GOV.UK guidance says Northern Ireland needs a Responsible Person established in Northern Ireland or in the EU. The Eldris UK appointment, held by EldrisAI, covers Great Britain only and not Northern Ireland.

Do toys follow the 2005 Regulations too?

Toys have sector rules that are separate from the General Product Safety Regulations 2005. This guide covers only the 2005 Regulations and the Great Britain cosmetics rules, not the sector rules. So a toy seller should read the Great Britain toy rules before relying on the general position in this guide.

Can a PO box be the UK address for cosmetics?

No: GOV.UK guidance says the Responsible Person for cosmetics sold in Great Britain needs a UK established address. Under that guidance, the address cannot be a mail-forwarding or PO box address. For Great Britain labels, Eldris uses EldrisAI, Unit 1, Out of the Woods, Halton, Lancashire, LA2 6ND, United Kingdom.
